[PASSED] Criminal Code Bill

Preamble

Be it enacted by the Crowned Assembly of Astoria, in accordance with the Constitution and for the purpose of maintaining law and order, that the following provisions shall constitute the Criminal Code within our jurisdiction.

Section I: Scope and Authority

1. This Code aims to establish a just and orderly society in Astoria. It outlines the definitions and penalties for offenses against the peace and harmony of our community.
2. The Supreme Court shall determine penalties for criminal acts based on the severity of the offense.

Section II: Criminal Offenses

Article 1: Misconduct

1. "Misconduct" is defined as whoever violates a legally mandated oath, willfully or negligently.

Article 2: Conspiracy

1. "Conspiracy" is defined as whoever plans or conspires to commit any offense.
2. "Conspiracy" shall also be brought if an individual or a group of individuals act upon the plans.

Article 3: Sedition and Treason

1. "Sedition" is defined as the subversion against the lawful government of Astoria or its allies.
2. "Treason" is defined as the deliberate act or the attempt to deliberately overthrow the lawful government of Astoria or its allies.
3. Any resident maintaining allegiance with a conflicting region or organization shall be barred from residing or participating in the governance of Astoria.

Article 4: Espionage

1. "Espionage" is defined as the unlawful sharing of confidential information, from Astoria or its allies, with organizations or parties that are not legally entitled to access it, without proper Legal authorization.
2. "Espionage" is also defined as the deliberate act of leaking sensitive information from Astoria or its allies to parties who are not legally entitled to access it.

Article 5: Fraud

1. "Fraud" is defined as the intentional perversion of the truth in order to gain an advantage or to damage another individual.
2. "Election Fraud" is defined as the deliberate act of interference with the legal electoral process to influence the result of an election.

Article 6: Defamation

1. "Defamation" is defined as the deliberate act of slander against an individual to discredit or harm an individual's character.

Article 7: Obstruction of Justice

1. "Perjury" is defined as providing false testimony under oath during criminal trials conducted by the Supreme Court.
2. "Tempering with Evidence" is defined as an individual who alters, conceals, falsifies, or destroys evidence with the intent to interfere with a criminal trial conducted by the Supreme Court.

Article 8: Spamming

1. "Spamming" is defined as the excessive, repetitive, or unsolicited posting of messages, content, or links, with the intent to disrupt or overload communication platforms.
2. Communication platforms include regional message boards, forums, and other digital spaces designated for communication within Astoria and its allied regions.
3. "Spamming" shall not be extended to areas specifically marked for spam.
4. The determination of excessive, repetitive, or unsolicited posting shall be at the discretion of the relevant authorities and shall take into account the context, nature, and frequency of the postings.
5. Relevant authorities shall, within the bounds of their power, issues warnings to individuals.
6. Repeated violations of Spamming shall result in escalating penalties.

Section III: Criminal Sentences

Article 1: Sentencing

1. The Supreme Court, after delivering a guilty verdict, shall sentence an individual according to the severity of their crime
2. The Supreme Court reserves the right to sentence an individual to a harsher sentence if the Court deems it necessary.
3. For less severe crimes, The Court may impose a suspension of voting rights, suspension of speech for a finite amount of time, or removal from office.
4. For more severe crimes, the Court may impose a full removal of rights and/or ejection and banned from the region for a finite or infinite amount of time.
5. For individuals convicted of a Conspiracy to commit any act shall be sentenced to a lessor degree depending on the severity of the conspiracy.
