The Constitution of Civiles Conservare

We the People of Civiles Conservare, in order to preserve Democracy, maintain Justice, extend Liberty and its blessings to the people of Civiles, to act as a guiding light to the Conservative Movement, and to uphold the values of Freedom, Liberty, and Happiness, do ordain and establish this Constitution of the Republic of Civiles Conservare.
May God bless us in our endeavors, forever holding to the principles of humanity and morality.


ARTICLE I: THE STATUE OF LIBERTIES

    All citizens reserve the right to Free Speech, Press, and Assembly;
      ✦ Free Speech is defined, under this constitution, as the ability to speak any unhateful words without fear of repercussion or suppression.
      ✦ Free Press is defined, under this constitution, as the ability to print publications that are independent of government moderation and modification.
      ✦ The Right to Assembly is defined, under this constitution, as the ability for citizens to assemble and unify themselves in order to support/oppose the government of Civiles Conservare and its actions, policies, etc.

        Under times of duress, these rights may be temporarily restricted through legislation passed by the Senate, and acceded to by the Rectrix.

    ✪ The Right to Religion of Choice, and Freedom from Persecution thereof;
    ✪ The Right to Apply for Citizenship;

      ✦ All those who seek citizenship in Civiles are allowed to do so, unless they are declared persona non grata by the High Court.

        Under times of duress, these rights may be temporarily restricted through legislation passed by the Senate, and acceded to by the Rectrix.

    ✪ The Right to Speedy Trial and Appeal for all crimes alleged against them, as well as the Right to Assumed Innocence before proven guilty of the accused crime;
    ✪ and the Right to Participate in Free and Fair Elections.
    ✪ Citizens of Civiles Conservare possess other rights not specified in this Constitution—rights of which the government has no authority to overwrite, and cannot deny.


ARTICLE II: THE LEGISLATIVE GOVERNMENT

Section I: The Consul

    ✪ The primary legislative authority shall be vested in a Consul, of which will be determined by a popular election of the citizenry.
    ✪ The Consul is tasked with drafting and maintaining interregional policy, assisting the Senate in performing domestic duties, and carrying out any other task required.
    ✪ A single citizen may hold the position for three months, and may not hold the position for more than three consecutive terms.
    ✪ If one does not meet the following terms, they may not hold the position of Consul.

      ✦ One must be a registered citizen of CC to hold the position of Consul;
      ✦ One cannot hold the position of Consul if they have previously been banned from the region, and have returned under another name;
      ✦ One cannot hold the position of Consul if they have received condemnation from the World Assembly;
      ✦ One cannot hold the position of Consul if they have held more than three consecutive terms prior to election;
      ✦ One cannot hold the position of Consul if they have been indicted for treason or other high crimes against Civiles Conservare;
      ✦ and One cannot hold the position of Consul if they do not meet additional stipulations in the Electoral Guidelines Dispatch.

    ✪ The Consul shall, with assent of two-thirds of the Senate, propose and sign treaties on behalf of Civiles Conservare alongside the Rectrix, and confirm nominations for Iudex.
    ✪ The Consul reserves the authority to fill vacancies in the Senate whenst they occur.
    ✪ The Consul can, if so desired, veto a piece of legislation before its passage with just cause.
    ✪ The Consul reserves the right to issue Consular Ordinances where they may declare a State of Emergency, State of Mobilization, and additional semi-legislative actions, with assent from the Rectrix, under the condition that they do not violate this constitution.
    ✪ The Consul, midway through elected term, shall draft an announcement to describe the State of the Republic, wherein they may suggest/propose legislation to further the success of the nation.
    ✪ Each term, the Senate shall elect one amongst their peers to the position of Consul-elect, who then shall be confirmed by the Rectrix to the position of Consul.
    ✪ Before entering office, the Consul-elect shall utter (and grant slight modifications to, if so wished) the following oath;

      I, [NAME], do solemnly swear to defend and uphold the Constitution of Civiles Conservare and the laws that derive from it; to defend the Republic for which we stand from threats both external and within her borders; to follow the principles of Liberty, Democracy, and Freedom; that I maintain allegiance to the people of Civiles Conservare; and that I enter this office of Consul without reservation and repudiation.

Section II: The Senate

    ✪ The Senate of Civiles Conservare shall consist of one Senator for every thirty residents; this number, at the time of writing, would number six senators.
    ✪ Senators are to be chosen during a general election by the citizens of Civiles. Their terms are to lawfully last three months, and they may hold no more than four consecutive terms.
    ✪ If a senatorial vacancy were to occur—whether it be resignation, ceasing to exist, or lack of individuals desiring election—the Rectrix and Consul together retain the authority to appoint citizens to these positions.
    ✪ To become a Senator, one must meet the following criteria.

      ✦ One must be a registered citizen of CC to hold the position of Senator;
      ✦ One cannot hold the position of Senator if they have previously been banned from the region, and have returned under another name;
      ✦ One cannot hold the position of Senator if they have held more than four consecutive terms prior to election;
      ✦ One cannot hold the position of Senator if they have been indicted for treason or other high crimes against Civiles Conservare;
      ✦ and One cannot hold the position of Senator if they do not meet additional stipulations in the Electoral Guidelines Dispatch.

    ✪ If a piece of legislation is vetoed by the Consul, the Senate has the ability to pass the legislation once again where it shall be declared law regardless of Consular action.
    ✪ The Senate maintains the power to issue Articles of Impeachment against any government official with just cause, and may initiate the process of Impeachment alongside the Iudex.
    ✪ The Senate may determine its own rules of order, and punish its members for violations of this conduct.
    ✪ The Senate shall assemble at a minimum of once per term to discuss the state of the region and legislative items.
    ✪ The Senate may issue the writs of combat by popular vote, wherein the citizenry will hold the ability to solidify a state of war against another region.
    ✪ The Senate maintains the power to issue additional legislation to further carry out the necessities of this constitution and the region for which it serves.
    ✪ Senators need not be a member of a noble peerage, though one who holds either of the mentioned is not restricted from holding office.
    ✪ Each term, one-fourth of all incumbent individuals must be replaced with a new participant. If this is rendered incapable, the heir shall receive a voting seat.
    ✪ Each term, the Senate shall elect one amongst their peers to the position of Consul-elect, who then shall be confirmed by the Rectrix to the position of Consul.
    ✪ All official conversations regarding the proposal, passage, or amendment of legal items must be recorded unless secrecy is determined necessary.
    ✪ No Senator, during their elected term, may hold an additional legislative, executive, or judicial office under government authority.

ARTICLE III: THE JUDICIAL GOVERNMENT

Section I: The Iudex

    ✪ The primary judicial authority shall be vested in the Iudex, of which shall be nominated by the Rectrix and confirmed by the Senate.
    ✪ The Iudex is tasked with determining the constitutionality of legislation, settling legal/judicial disputes, handling the impeachment of legislative officials or additional legal figures, and any additional tasks that may be asked.
    ✪ Once appointed as Iudex, one may hold the position as long as one continues to receive Senatorial approval. In the case of impeachment, the individual holding the position is barred from regaining it for a minimum of eight months unless otherwise decided by the Senate or Rectrix.
    ✪ If one does not meet the following terms, they may not hold the position of Iudex.

      ✦ One must be a registered citizen of CC to hold the position of Iudex;
      ✦ One cannot hold the position of Iudex if they have previously been banned from the region, and have returned under another name;
      ✦ One cannot hold the position of Iudex if they have received condemnation from the World Assembly;
      ✦ One cannot hold the position of Iudex if they have been indicted for treason or other high crimes against Civiles Conservare;
      ✦ and One cannot hold the position of Iudex if they do not meet additional stipulations in the Electoral Guidelines Dispatch.

    ✪ The Iudex holds the ability to confirm impeachment motions against legislative or additional figures.
    ✪ The Iudex has the final say in all civil disputes and the determination of the legality of legislation.
    ✪ Upon receiving office, the newly appointed Iudex will swear the following oath.

      I, [NAME], do solemnly swear that I shall administer justice without bias or preference; to uphold the laws of Civiles Conservare and the Constitution from which they derive; to maintain allegiance and union to Civiles; and that I enter this office without reservation or repudiation.

ARTICLE IV: ADDITIONAL POSITIONS

Section I: The Caput Nuncii & the Legatus

    ✪ The Caput Nuncii, alongside the Legatus, are military positions appointed by the Rectrix once receiving two-thirds support from the Senate. They are positions lacking political authority, instead, they advise the Republic on military and intelligence matters.

    ✪ The Caput Nuncii and Legatus, respectively, shall lead the Frumentarii and Legion of Civiles Conservare.
    ✪ Both positions are appointed by the Rectrix, then confirmed after gaining support from two-thirds of the Senate.
    ✪ A single citizen may hold the positions of Caput Nuncii or Legatus for no more than four consecutive terms, each lasting three months respectively.
    ✪ If during a term, the Caput Nuncii or Legatus were to resign, be impeached, or cease to exist, the Rectrix retains the duty to appoint another one as swiftly as possible.
    ✪ If one does not meet the following terms, they may not hold the position of Caput Nuncii or Legatus.

      ✦ One must be a registered citizen of CC to hold the position of Caput Nuncii or Legatus;
      ✦ One cannot hold the position of Caput Nuncii or Legatus if they have previously been banned from the region, and have returned under another name;
      ✦ One cannot hold the position of Caput Nuncii or Legatus if they have held more than four consecutive terms prior to election;
      ✦ and One cannot hold the position of Caput Nuncii or Legatus if they have been indicted for treason or other high crimes against Civiles Conservare.

    ✪ Upon receiving office, the newly appointed Caput Nuncii or Legatus will swear the following oath.

      I [NAME], do solemnly swear to defend the nation for which Civiles Conservare stands from enemies both internal and external; that I maintain allegiance to the same; that I will discharge my duties responsibly and properly; and that I enter this office without reservation or repiduation.

Section II: The Archivist

    ✪ The Archivist records regional documents, government publications, and additional communications duties from the regional government to residents.
    ✪ The Archivist shall coincide with the nation Archivist of Civiles Conservare, a nation maintained by the Rectrix.

      ✦ The Rectrix may decide to share ownership of the nation with fellow members of the government, but it is strictly prohibited to do so with nations hailing from outside communities.

ARTICLE V: THE CITIZENRY

    Citizens, otherwise referred to as a Civis, are the individuals for which our democracy stands. They are defined as an individual who resides within Civiles Conservare, and has been granted citizenship.

      ✦ Citizens hold the privilege of voting rights and legislative proposals;
      ✦ Running for, and holding a government position;
      ✦ Participating in the regional roleplay, and any additional activity offered by the regional government;
      ✦ Joining the Discord Server;
      ✦ and additional unlisted abilities.

    ✪ A Resident is clarified as an individual who resides within Civiles, and lacks citizenship status.

      ✦ All residents hold the right to apply for citizenship, through both NationStates and/or Discord.

    ✪ Citizenship is gained by applying for such, and receiving approval by the Rectrix, Consul, or Iudex.
    ✪ Citizens hold the right to submit legislative proposals and constitutional amendments, and to participate in government operations overall.

ARTICLE VI: THE ELECTORAL/IMPEACHMENT PROCESS

Section I: Electoral Overview and Clarifications

    ✪ Civiles Conservare maintains a free and fair electoral process, wherein the citizenry elects individuals to represent them in government.
    ✪ The electoral process is to be delivered in more detail in the Electoral Guidelines Dispatch.
    ✪ Only registered citizens of fourteen days may vote in elections.
    ✪ Citizens may use one registered nation to participate in the electoral process.
    ✪ If an individual is found to have committed electoral fraud, their votes shall be declared null and void.

      ✦ Electoral fraud is defined as the use of multiple nations to vote in an election, planned manipulation of elections, or additional cases of manipulation to further one's own progress.

Section II: Consular Elections

    ✪ The Consul of Civiles Conservare shall be elected by Senators amongst their peers from the majority party, or of a member most capable of operating the government under a coalition government.
    ✪ Senators possess up to two weeks to elect a Consul.

      ✦ If there is only one candidate, they are to immediately be elected Consul;
      ✦ If there are multiple candidates, the election is to proceed accordingly.

    ✪ Candidates are required to submit their campaigns a minimum of twenty-four hours prior to the opening of polls.
    ✪ If a ticket is to campaign, it must be civil and polite in regard to those the candidate runs against.
    ✪ Consular Candidates must be affiliated with a political association.

    ✪ Upon election, the newly sworn-in Consul is to release a statement defining their goals and ambitions for their term.

Section III: Senatorial Elections

    ✪ Senatorial elections are to be held beginning on the fifteenth of every third month, and conclude following the elections of each Senator.
    ✪ The polls for senatorial elections are to be one day long for each candidate.

      ✦ If there are a minimal amount of candidates, they are to immediately assume office.
      ✦ If there are multiple candidates, the elections are to proceed accordingly.

    ✪ To run for Senator, one must have attained citizenship a minimum of fourteen days prior to submitting their ticket.
    ✪ Candidates are required to submit their campaigns a minimum of twenty-four hours prior to the opening of polls.
    ✪ If a ticket is to campaign, it must be civil and polite in regard to those the candidate runs against.
    ✪ If a ticket is to campaign, they are allowed to submit one telegram to the Archivist for regional dispensing. Any additional telegrams must be sent by those campaigning individually, though this is not to be excessive. If one is found spamming they are to be reprimanded and suspended from campaigning for a minimum of seven days.
    ✪ Senatorial Candidates must be affiliated with a political association.

Section IV: The Impeachment of Legislative or Judicial Officials

    ✪ Impeachment is hereby defined as a procedure in which a legal official is removed from office due to misconduct, maladministration, or unconstitutional action.
    ✪ Any citizen may announce allegations of misconduct against an official, after which the High Court or other entities may launch investigations into the accused.
    ✪ If an official is accused of unconstitutional action or misconduct, the accusor will disclose any information regarding the charges to the Iudex; After which, the Iudex is constitutionally compelled to launch an investigation into the charges to verify any claims made. After the conclusion of the investigation, all information obtained will be delivered to the Senate and Rectrix. The Senate then holds the right to launch a trial of conviction against the accused. If the Senate decides in favor of their guilt, the verdict is to be delivered to the Rectrix and Iudex; the two officials must unanimously agree in favor of the charges, after which the official in question will be impeached. If unanimous agreement is not reached, the region at large will be notified of the conviction where the citizenry may launch a referendum of impeachment against the accused.
    ✪ In the case of impeachable actions having been undertaken by the Iudex, the Rectrix shall undertake the responsibilities usually carried out by the Iudex during the process of impeachment.

ARTICLE VII: THE FOUNDER

Section I: In Aeternum

    ✪ The Eternal Founder, herein referred to as the Immortalis, is Rano (otherwise known as Adawn). He is the symbolic Keeper of Civiles Conservare and it's predecessor, the League of Conservative Voices.
    ✪ The Republic of Civiles Conservare recognizes the Immortalis as the Father of the Conservative Movement on NationStates, and as such, one of the ideological representatives of CC and the sole one of her predecessor.
    ✪ While the Immortalis holds no legal position, he shall be bestowed the honorary position of Patrician of Conservum, and maintain the right to claim a permanent voting seat in the Senate should he request.
    ✪ Civiles Conservare and her leadership shall recognize that while times have indeed changed, the Immortalis is the ideological founder of CC, and for that reason is an individual of great esteem.

Section II: Ille Rectrix

    ✪ The Rightful Founder, formally the Rectrix of Civiles Conservare, is Cuzataetl.
    ✪ The Republic of Civiles Conservare recognizes the Eternal Rectrix as the heir to the legacy of Rano, and as such, one of the ideological representatives of CC.
    ✪ While the Rectrix holds no legal position, she shall be bestowed the honorary title of Matrician of Libertas, and shall be granted permanent citizenship of Civiles Conservare—regardless of the region in which she resides.
    ✪ In the case of vacancy in the position of Rectrix, the Eternal Rectrix shall assume the position of Princeps until elections are held for a new Rectrix. The Eternal Rectrix is permitted to run in this election.
    ✪ The Eternal Rectrix, as the gameside founder of Civiles Conservare, shall be second in the line of succession for governor of CC.
    ✪ Should she desire, the Rectrix holds the ability to lawfully request to become an advisor to the Senate and/or the current Rectrix.

ARTICLE VIII: THE WORLD ASSEMBLY

    ✪ As a nation within the multiverse known to NationStates, the Republic of Civiles Conservare formally adheres to the World Assembly and pledges to recognize its functions.
    ✪ The World Assembly Delegate is the WA representative of Civiles, and shall represent CC in the organization.
    ✪ CC solicits its residents to join the World Assembly, and to endorse one another as a means to increase the region's presence in the WA and increase Regional Power.
    ✪ Civiles Conservare renounces a fixed WA policy, and instead will establish her decisions regarding pending legislation in the WA.
    ✪ The World Assembly Delegate shall coincide with either the position of Consul or Iudex. The Senate shall decide which will assume the position of delegate.
    ✪ The position of WA Delegate is, at most, a functional one. It shall hold no regional powers other than that of
    World Assembly.
    ✪ Under no circumstances shall the WA delegate become the executive of Civiles Conservare. If that happens, regional government is required to act at quick speed to secure a trustworthy delegate so that regional prosperity may resume.

ARTICLE IX: CONSTITUTIONAl AMENDABILITY

    ✪ The citizens of Civiles Conservare recognize the importance of an economical constitution, and as such, reserve the authority to propose amendments to this concordat.
    ✪ An amendment may be put to vote if it is deemed lawful by the Rectrix and Iudex.
    ✪ No amendment shall be put to vote if it terminates Articles I, II, III, IV, VI, VII, VIII, or IX.
    ✪ No amendment shall be put to vote if it terminates Article I Sections I & II & III, Article II Sections I & II, Article III Section I, Article V Section II, and Article VIII Section I.
    ✪ For an amendment to pass, a majority of the participating citizenry must vote in favor of the preposition.
    ✪ Any passed amendment will be listed below this article, and marked with the date of passage as well as the proposer.

Type of Legislation: Amendment

Purpose of Legislation: To edit the constitution in order to reflect our other voting processes.
Reasoning Behind Legislation: ⅔ majority is a lot.

The Effective Changes to Article X of the Constitution

  1. For an amendment to pass, a majority of the citizens that voted on the proposal.

Article X Proposed Outcome

  1. The citizens of Civiles Conservare recognize the importance of an economical constitution, and as such, reserve the authority to propose amendments to this concordat.

  2. An amendment may be put to vote if it is deemed lawful by the Princeps and Iudex.

  3. No amendment shall be put to vote if it terminates Articles I, II, III, IV, VI, VII, VIII, or X.

  4. No amendment shall be put to vote if it terminates Article I Sections I & II & III, Article II Sections I & II, Article III Section I, Article V Section II, and Article VIII Section I.

  5. For an amendment to pass, there must be a 1/2 majority of the region's citizenry that voted on the proposal.

  6. Any passed amendment will be listed below this article, and marked with the date of passage as well as the proposer.
