The Libertatem Department of Justice is the court system for the region of Libertatem. It is headed by Regional Justice Miencraft, an originalist and textualist veteran of the region. The Justice Department exists to mediate and resolve legal and constitutional disputes that may arise between residents of Libertatem, or conflicts involving the regional government itself.

Any nations wishing to bring a case before the Court should ask the Regional Justice to arrange a hearing.
It's recommended but not required to consult with the Attorney General beforehand.

The Regional Justice
Current term ends: May 24 2019

The Regional Justice is an appointed cabinet-level judicial position that, though not an official member of the cabinet, is nominated by the President. The nomination must be confirmed by a vote in the Senate. Upon confirmation, the Justice serves a term of twelve months from the time he is confirmed. The Justice is the final judicial authority in the region, though his decisions may be appealed by unanimous Senate vote. The Justice is barred from holding any other office for the duration of his tenure.

The current Regional Justice, Miencraft, is a veteran of Libertatem who arrived in late 2012, a mere three months after the region's founding. During the First Republic, he served on the Old Board, which was a position held by five bureaucrats appointed directly by the Founder Liberosia. He acquired the position of Chairman of the Board sometime in either late 2012 or early 2013, and then allowed his nation to cease to exist. He returned several months later, in October of 2013, during the tenure of President Pevvania. He became a member of the First Elected Board in January 2014, and continued to serve as a Boardsman until July 2014. At some point, he became the Manager of Internal Affairs and served in that capacity for some time. Miencraft first became President of Libertatem after serving as the Vice-President to Humpheria for a month, at which point Humpheria resigned his position. The Miencraftic presidencies are largely unnotable, and he served as Manager of Internal Affairs for several presidents after himself. He became the final President of the First Repubic in April of 2016 following the dissolution of the Right-Winged-Nation Administration, and in this capacity he ushered in the Second Republic, being elected unopposed as the First President of the Second Republic. After completing a single term, Miencraft retired from regional politics until being called upon to serve as Regional Justice in May 2017.

Using violence, or the threat thereof, to coerce people into giving you money is called robbery, or at least it is when a private citizen does it; when the government does it, it's called taxation.

Miencraftic Court Shorthand
The Miencraftic Department of Justice uses this shorthand officially in all statements.

Law X:Y.Z

Here, X is the Section, Y is the Subsection, and Z is the Line, for all normal laws.
Z is optional and may not appear if the relevant subsection only has one line, or all of it is being referred to.
If a section has no subsections but has multiple lines, Y will be excluded and the line will be referred to in longhand, like so:

This is expanded for the Constitution, or any other law large enough to need to be divided into Articles.
For these, an extra Article number is added at the start of the list. Here it is represented by A.

For Constitutional Amendments, the same shorthand is used as for regular laws, treating the amendment's number as part of the law's name.

Law names will always be the name that the law is listed under in the law archives, removing any titles such as "Act", "Law", etc.
The Constitution is referred to with the abbreviation "Cstn", and any amendments use the abbreviation "Amdt".
Amendments will always be referred to by number, even if they have names.

The Attorney General

The Attorney General is a cabinet member who, though technically not part of the Department of Justice, holds the position of the government's lawyer. Officially, the Attorney General represents the Second Republic of Libertatem, and also serves as a public representative of any plaintiff bringing a case to civil or criminal trial. As a cabinet member, the Attorney General shares a term with the President.

The current Attorney General is The United States of Patriots.

The Solicitor General
The Solicitor General is appointed directly by the Regional Justice to represent the People of the Republic. The Solicitor General serves as the public defender for any nations charged in civil or criminal trials, and petitions on the behalf of the People during Constitutional trial.

The current Solicitor General is Snany.

History of Cases
All court cases except Libertopia v. Roads can be found in full in the community discord.

On July 13, 2016, the Justice Department under Regional Justice Humpheria heard the case of LinkBad Libertopia v. Muh Roads. The Manager of Internal Affairs during the final stretch of the First Republic, Muh Roads, was charged with Negligence, Abuse of Power, Defamation, and Malice as a result of his not processing applications for citizenship during the period of choosing and ratifying a new Constitution. The Court found Roads not guilty of all charges due to the Second Republic constitution having completely abolished the prior government, the fact that Second Republic law cannot retroactively apply to citizens of the First Republic, and the fact that several of the charges against Roads were not real crimes under either Constitution.

On May 29, 2017, the Court under Justice Miencraft heard arguments for Second Republic of Libertatem v. Communisim. Communisim was to be charged with Espionage by Special Prosecutor VenomRingo in lieu of an active Attorney General, and the court date was given as June 1, 2017. On that date, the Special Prosecutor dropped all charges.

On June 28, 2017, the Court heard arguments for Second Republic of Libertatem v. Auxorii. Auxorii was charged with Treason by Special Prosecutor VenomRingo. The defendant plead no contest and was banished from Libertatem for a month with unlimited appeal. Evidence later arose that Auxorii was attempting to evade banishment, and so his ban was upgraded to permanent with no appeal. The Court heard arguments for Second Republic of Libertatem v. LibIceland and Hyderbourg on July 3, 2017. The defendants were charged with collusion to ban evasion for assisting Auxorii in continuing to participate in Libertatem affairs even after his banishment, and were also held in contempt of court for failure to comply with a court order to hand over evidence. The case Linkwent to trial on July 7, 2017. On July 12, a jury found both defendants guilty of all charges, and they were permanently banished. On July 13, the nation of Kohalo was revealed to be a puppet of Auxorii, and was banished. On September 10, the Senate voted to lift LibIceland's ban, with a stay on citizenship until October 1.

On November 20, 2017, Auxorii took advantage of a bug that removed nations from regional ban lists if they ceased to exist, and returned to Libertatem. He claimed that he "[planned] to just keep to [himself] at this point. Maybe taking part in discussion every once in a while." He declared that he had "no current plans to get involved with regional politics." As it is obvious that Auxorii did not understand the meaning of the word "permanent", he was banned again, and despite feigning disinterest, attempted to negotiate with several government officials to gain re-entry to Libertatem. His hopes were promptly dashed when it turned out that nobody actually cared about anything he had to say by that point.

On December 20, 2017, the Court began hearing arguments for VenomRingo v. Second Republic of Libertatem. VenomRingo contended that President Pevvania wrongfully believed that the President was the ultimate leader of the Libertatem Armed Forces. The case went to Constitutional Trial on the 21st and was resolved the same day. The Court concluded that the Chancellor of War is under no obligation to report to the President, though recommended that the Chancellor do report to the President regardless. The Court also stated that if the President wishes to maintain control of the Libertatem Armed Forces, the President may leave the Chancellor of War position unfilled.
